Planning for Incapacity
Planning for your care in case you become incapacitated and can't make decisions about your care and funds is another essential part of estate planning that you shouldn't forget. You can name someone you trust as your agent through an Advance Directive. You choose a healthcare agent with a Power of Attorney to make important decisions about your medical care. A Living Will tells medical workers (doctors, nurses, etc.) what you want them to do in an emergency medical situation regarding life support, feeding tubes, or other heroic measures to save your life.

A Power of Attorney is a legal paper that gives someone else the legal right to do certain things for you—the rights they have depend on what the document says. You can make your Power of Attorney very broad or very narrow and specific. All powers of attorney end when the person who made them dies, and they may also end if the person who made them (the principal) becomes incapacitated, which means they can't make or communicate choices. It is best to use a Durable Power of Attorney if you want your agent to be able to keep making decisions for you if you become incapacitated.
